SampleVault maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. This policy applies equally to free uploaders and certified sellers.

• We record and review valid takedown notices associated with uploader accounts.
• Repeated or serious infringement may result in account suspension or termination, taking successful counter-notices and the circumstances of each case into account.
• Enforcement decisions are documented and reviewed by an administrator.

If your content was removed under a DMCA takedown notice and you believe the removal was a mistake or misidentification, you have the right to file a counter-notice under 17 U.S.C. § 512(g).

What a valid counter-notice must include

1. Your physical or electronic signature.
2. Identification of the material that was removed, and the location at which it appeared before removal.
3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
4. Your name, address, and telephone number.
5. A statement that you consent to the jurisdiction of the federal court in the district where you live, or — if you are outside the United States — for any judicial district in which SampleVault may be found, and that you will accept service of process from the original claimant.

What happens after you file

• We forward your counter-notice to the original claimant.
• If the claimant does not file a court action within 10 to 14 business days, we restore the content to the platform.
• If the claimant files a court action, the content remains removed until the court decides otherwise.
